Opening D.C. Circuit Brief Filed Challenging Highly Polluting Uranium Mining Project

December 19th, 2016 – On behalf of the Natural Resources Defense Council and Powder River Basin Resource Council, the Firm has filed a brief challenging the Nuclear Regulatory Commission’s permit for Strata Energy, Inc.’s Ross Project, an “In Situ Leach” uranium mining operation in Northeastern Wyoming.  Under that environmentally degrading technology, a company deliberately pollutes an aquifer with chemicals in order to dissolve otherwise inert uranium into the water, which is then pumped back to the surface for removal of the uranium. Inevitably, these projects highly pollute the aquifer and threaten surrounding groundwater, but the Commission incongruously found the Ross Project would have little adverse impact on the environment.  Our case challenges that finding, and the agency’s refusal to reconsider the permit after revealing that, contrary to the disclosures in the Environmental Impact Statement, the Ross Project is likely to exponentially raise uranium levels in the aquifer.
